Welcome to Revolutionz USA. By accessing or using our website and purchasing our products or services, you agree to be bound by these Terms of Service. Please read them carefully.

1. Acceptance of Terms

By accessing and using revolutionzusa.com (the "Website"), you accept and agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree to these terms, please do not use our Website or services.

2. Products and Services

2.1 Product Descriptions

We strive to provide accurate product descriptions and specifications. However, we do not warrant that product descriptions, specifications, pricing, or other content on the Website is accurate, complete, reliable, current, or error-free.

2.2 Pricing

All prices are listed in US Dollars (USD) and are subject to change without notice. We reserve the right to modify prices at any time. The price charged will be the price displayed at the time of purchase.

2.3 Product Availability

We make every effort to ensure products are in stock. However, we cannot guarantee availability. If a product becomes unavailable after your order, we will notify you and offer a refund or alternative product.

3. Engine Service Terms

3.1 Service Process

Engine service orders require a service fee payment ($75 standard or $200 expedited) which includes:

  • Reserved spot in service queue
  • Prepaid shipping label to our facility
  • Complete engine inspection
  • Detailed quote for required service

3.2 Service Quotes

After inspection, you will receive a detailed quote with photos and measurements. You must approve the quote before we proceed with service work. The service fee is credited toward your final invoice.

3.3 Service Turnaround

  • Standard Service: 7-10 business days after quote approval
  • Expedited Service: 2-3 business days after quote approval

Turnaround times are estimates and may vary based on parts availability and workload.

3.4 Service Warranty

All service work is backed by a 90-day warranty against defects in workmanship. This warranty does not cover damage from racing incidents, improper use, or normal wear and tear. Return shipping for warranty work is the customer's responsibility.

4. Engine Rental Terms

4.1 Rental Process

Engine rentals require full payment at checkout. After purchase, you must provide race details and delivery preferences. We will coordinate shipping or track delivery based on your event.

4.2 Rental Pricing

Rental rates are $250 per day with a 2-day minimum. Pricing includes new spark plug, condition documentation, and return shipping (if shipped to customer initially).

4.3 Condition Documentation

We provide detailed condition photos before rental. Customers must take similar photos before returning the engine. Failure to provide return photos may result in forfeiture of damage deposit or additional charges.

4.4 Damage Responsibility

Customers are responsible for all damage to rental engines beyond normal racing wear. Damage assessment is based on comparison of before/after photos. Customers will be invoiced for repair costs.

4.5 Rental Cancellations

  • 7+ days before rental: Full refund minus 10% processing fee
  • Within 7 days of rental: No refund

5. Ordering and Payment

5.1 Order Acceptance

All orders are subject to acceptance and availability. We reserve the right to refuse or cancel any order for any reason, including but not limited to product availability, errors in pricing or product information, or suspected fraud.

5.2 Payment Methods

We accept major credit cards, debit cards, and PayPal. Payment is due at the time of order unless otherwise agreed in writing.

5.3 Payment Security

All payment transactions are processed securely through Shopify's payment gateway. We do not store credit card information on our servers.

6. Shipping and Delivery

6.1 Shipping Methods

We ship via UPS and USPS. Shipping costs are calculated at checkout based on weight, dimensions, and destination.

6.2 Delivery Times

Estimated delivery times are provided at checkout but are not guaranteed. We are not responsible for delays caused by shipping carriers or events beyond our control.

6.3 Risk of Loss

Risk of loss and title for products pass to you upon delivery to the carrier. We recommend purchasing shipping insurance for high-value items.

7. Returns and Refunds

7.1 Return Policy

New, unused products in original packaging may be returned within 30 days of purchase for a refund. Customer is responsible for return shipping costs unless the product is defective or we made an error.

7.2 Non-Returnable Items

  • Used or installed products
  • Products without original packaging
  • Custom or special-order items
  • Service fees (unless service is not performed)

7.3 Refund Processing

Refunds are processed within 5-7 business days of receiving the returned product. Refunds are issued to the original payment method. Original shipping costs are non-refundable unless we made an error.

8. Warranties and Disclaimers

8.1 Product Warranties

Products are covered by manufacturer warranties where applicable. We are not responsible for manufacturer warranty claims. Customers should contact manufacturers directly for warranty service.

8.2 Service Warranty

Our service work is warranted for 90 days against defects in workmanship. This warranty is limited to repair or replacement of defective work and does not cover consequential damages.

8.3 Disclaimer of Warranties

EXCEPT AS EXPRESSLY PROVIDED, ALL PRODUCTS AND SERVICES ARE PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE.

9. Limitation of Liability

IMPORTANT: TO THE MAXIMUM EXTENT PERMITTED BY LAW, REVOLUTIONZ USA SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF OUR PRODUCTS OR SERVICES.

Our total liability for any claim arising out of or relating to these Terms or our products and services shall not exceed the amount you paid for the specific product or service giving rise to the claim.

10. Racing and Competition Use

10.1 Assumption of Risk

Karting and motorsports are inherently dangerous activities. By purchasing products or services for racing use, you acknowledge and assume all risks associated with competitive motorsports.

10.2 Compliance with Rules

You are responsible for ensuring that all products and services comply with applicable racing organization rules and regulations. We do not guarantee compliance with any specific racing series or organization.

10.3 Technical Support

Technical support and setup advice is provided as a courtesy and does not constitute a guarantee of performance or results.

11. Intellectual Property

All content on this Website, including but not limited to text, graphics, logos, images, and software, is the property of Revolutionz USA or its licensors and is protected by copyright, trademark, and other intellectual property laws.

You may not reproduce, distribute, modify, or create derivative works from any content on this Website without our express written permission.

12. User Conduct

You agree not to:

  • Use the Website for any unlawful purpose
  • Interfere with or disrupt the Website or servers
  • Attempt to gain unauthorized access to any portion of the Website
  • Impersonate any person or entity
  • Transmit any viruses, malware, or harmful code

Any dispute arising out of or relating to these Terms or our products and services shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association.

15.3 Class Action Waiver

You agree that any arbitration or proceeding shall be limited to the dispute between you and Revolutionz USA individually. You waive any right to participate in a class action lawsuit or class-wide arbitration.

16. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.

17. Entire Agreement

These Terms, together with our Privacy Policy and any other legal notices published on the Website, constitute the entire agreement between you and Revolutionz USA regarding your use of the Website and purchase of products and services.
